Notice on the activation of the video surveillance system pursuant to European Regulation 2016/679 (GDPR)
We inform you that Movex S.p.A. Italia (hereinafter, the “Company”) has activated a video surveillance system through which personal data relating to you, represented by your images, may be processed. Therefore, we wish to provide the following information.
Purpose
The video surveillance system aims to protect access to the Company’s headquarters and offices and to safeguard company assets.
It is believed that the video surveillance system may effectively detect early signs of fire or other abnormal situations that could endanger the safety of people and property, as well as deter acts of vandalism, theft, or robbery. It may help identify perpetrators of crimes against company assets and facilitate, in the event of unlawful acts, the Company’s exercise of its rights in civil or criminal proceedings based on the images collected. For these reasons, installation of the system is justified by the type of premises and is based on the Company’s legitimate interest in protecting its assets and ensuring the safety of individuals.
Data processing carried out through the cameras pursues legitimate objectives and complies with the provisions of the Workers’ Statute (Law no. 300 of 20 May 1970), applicable legislation on personal data protection, and the general provision on video surveillance issued by the Italian Data Protection Authority on 8 April 2010.
Necessity and proportionality of processing
In relation to the purposes outlined above, and considering the characteristics of the equipment, installation of the video surveillance system must be regarded as necessary and proportionate.
The system significantly improves the safety of individuals and property and facilitates the Company’s potential right of defense in judicial proceedings. Given its characteristics, it is not excessive in relation to the stated purposes.
The recording of images is continuous over a 72-hour period. Automatic zoom functions are not activated.
Only specifically authorized individuals may access recorded images and exclusively for strictly necessary reasons, namely:
Additional features of the system
Recorded images may only be viewed by individuals operating under the authority of the Company who have been specifically instructed in writing. Furthermore, such images may be viewed by GEL Elettrica s.r.l., the company providing surveillance services, which has been appointed Data Processor for this purpose. The updated list of the above-mentioned entities is available upon request from the Company.
Retention period of images
Images are retained for a period of 72 hours from the time they are recorded, except in cases of specific requests by Judicial Authorities. Images are therefore kept only for the time necessary for viewing and for assessing any subsequent actions to be taken, including reporting to the competent authorities. Deletion is automated through overwriting, using methods that make the deleted data non-retrievable.
Scope of communication of personal data collected
Personal data contained in the images may be communicated, in the presence of unlawful acts or suspected unlawful acts, to judicial or law enforcement authorities.
Rights regarding data protection and the right to lodge a complaint with the supervisory authority
The Company, provided that the legal conditions are met and limited to the recording of images, will ensure the exercise of your relevant rights.
In particular, by contacting the Company via e-mail at [email protected], data subjects may request access to their images, request restriction of processing, and/or request erasure where applicable.
You also have the right to object, for reasons related to your particular situation, when processing is based on legitimate interest. In such cases, the Company will cease processing your personal data unless it demonstrates compelling legitimate grounds that override the interests, rights, and freedoms of the data subject, or if processing is necessary for establishing, exercising, or defending a legal claim.
The right to data portability under Article 20 GDPR does not apply, as processing is carried out based on the legitimate interest of the Data Controller.
Contacts
The Company’s contact details, as Data Controller, for exercising your rights are as follows:
